Im wondering if you did not qualify for FMLA but took time off for the baby how that worked. How much time did you take? Did your employer provide your benifits anyway? Did you feel your job was secure?

Turns out that in the state of California they cannot terminate you for pregnancy even if you don't qualify for FMLA. CA is an employee-friendly state. Look up something called the Pregnancy Disability Leave Act for the state of CA. And if all else fails, call the Department of Housing and Fair Employment (or just tell your HR dept that you're goinmg to,. that should shape them up right away).
I went through a nightmare with this this past summer. I hope it goes smoothly for you.
It's for my husband. He works for a small consulting company that's part of a bigger company out of state. It doesn't meet the minim 50 person for fmla. But he pays into state disability so he can get PFL.
My suggestion would be to get his requested leave in writing. If they approve it and its in writing, then they can't 'take it back' e-mails count, btw.

my firm is too small to qualify for FMLA but i was still able to negoiate 7 wks off when dd was born (it was wrapped up in my offer letter). the firm covered my benefits and thankfully i had a job to return to once my leave was up. i wasn't too worried about it since i was 7 month pg when i started and was VERY adamant about my return after a short leave.

My husband's employer wasn't cover by FMLA either. They agreed to let him take two weeks off and knew nothing about California's Paid Family Leave program. So we did that all ourselves. We filled out the paperwork and sent it in, and kept all the records. In the end, he went back to work when DS was 2 weeks old but his employer allowed him to work reduced hours without pay (and he had no vacation time left) and we used the PFL program to make up for his lost wages. He worked part time for at least two months before the maximum benefit ran out. He got to work and keep his job, I got help when I needed it (he went in late and came home early every day), and we didn't suffer a financial hardship. Win, win, win.
DH didn't/doesn't qualify either. But his employer is an idiot and doesn't understand that the PFL isn't mandatory so I think that's how he got by with getting the time off. Last time was 4 weeks, this time 5 weeks because of my complications. He doesn't get benefits from them so that was a non-issue, and he never feels his job is secure so that's a non-issue as well, ha!
Basically he said he wanted to take x amount of time and they could say yes or no. They said yes, but really only because they think they don't have a choice.
