FMLA and part time?

Hi everyone!  I obviously do not belong over here for quite awhile but since you girls are probably in the midst of FMLA rules and regulations I thought I would ask you!

I just got a part time job (start in 2 weeks).  It is 16 hours a week.  Would I even be eligable for FMLA since I am so new and only part time?  Thanks a lot!!

  • Hmmm. I would definitely ask someone at your job about this bc from what I understand, every company's FMLA rules and regulations differ. Good luck and congratulations! (On your pregnancy AND the new job!)

  • I believe that you have to have worked there for at least 12 months and have at least 1200 hours worked.

  • This!!! My company has a different policy for people who haven't been employed with us for a year. Every company differs and I suggest setting up a meeting with someone in your HR to find out about your FMLA, benefits, etc.
  • Your state/company may have a policy that you'll fall under, but you will not qualify for FMLA. PP is correct, FMLA requires 12 months and 1200ish hours.

  • FMLA is federal law but certain states have their own laws as well. For instance, NJ will pay for leave but federal leave provides for no pay.

    Like PP said, if you work for a covered employer (50 or more employees), you have to have worked there for 12 months (don't have to be consecutive) and 1200 hours.

    Do a search for your state & FMLA to see if they have any special provisions.
