We had court today-AGAIN

It seems like it will never end.

We had a "return from mediation" to check in about what we had agreed to at mediation.  Basically after I got done with mediation I wasn't comfortable with what we had discussed (SD getting unsupervised visits IF he presented a clean hair follicle test).  So I told my lawyer this and we said we didn't agree.

The judge reset mediation and also set a date for trial.  It's likely we won't be able to agree in mediation and it will have to go to trial.  That's when we will bring up that he hasn't seen P in over two months, as well as his criminal and drug charges.  SD was FURIOUS and whined to the judge, "I don't understand, we AGREED in mediation.  I just want to see my son".  His lawyer told him to be quiet. 

I honestly hope it doesn't go to trial but in a way it might be good for the court to find out EVERYTHING that SD has been up to.  It also will not look good that he hasn't exercised any of his right to have supervised visits.  My ultimate goal would be for SD to have to prove a period of time (say 6 months) of clean hair follicle tests before considering UNSUPERVISED visits.

::sigh::  I am getting fatigured with all of this, but in the end the main thing is that P is safe.

  • Hang in there...with a record like his, there's no way a judge is even going to consider giving him unsupervised visits.  In addition to demanding 6 months of clean drug tests, I'd also ask the court to require him to complete a drug counseling program and/or a certain number of counseling sessions on an outpatient basis with a drug counselor.  And I know a trial is a hassle but you will win, hands down, without a doubt.

    You're not being unfair and unreasonable.  SD is a known drug user.  Ask the stupid a$$ mediation man if he'd be willing to hand his kids over to someone like SD.  I know that courts can require the counseling because my ex DB had a drug problem in his past and had to do the counseling in order to get unsupervised visits with his kids (I believe he also had to have a certain number of clean drug tests too but I'm not sure because that was all way before I knew him).

     Don't let anyone make you feel bad for looking out for P's safety and best interests!

  • So glad the judge told SD to be quiet...shows right there that no one is falling for his boo hoo woe is me attitude about not seeing his son...if he REALLY wanted to he could exercise his right for supervised visits like you said and I am sure the judge saw it this way also! 

    A trial would be a PITA but at least you'd know everything would come out about what a douche he is and there is no way in HE!! he would ever get supervised visits from any judge in their right mind!  Hang in there and I'm glad that your lawyer is behind you 100%!! :)
