F/U to he filed for divorce

Sorry to be a post hog but it's been one of those days.   

I met with my lawyer today.  I guess I can officially call him my STBXH now, well, he told me the paperwork had been started and would be filed within a few days.  The lawyer I met with (where i live now) said that we might as well let him pay to file because I would have to file the papers there anyway.  The divorce code in WV says that the person filing has to file where we last lived together or where the recipient lives (which is the same county if I had filed)  She also said that I could petition for it to be moved here if I wanted, but that she would look into it as far as which would be easier/better overall.  She seems like she's pretty good and even said that she would be willing to travel the 2 hours to where the court dates would be and wouldn't charge an arm and leg to do so.  And as soon as I told her I definitely wanted her to represent me she called his lawyer and left a message. 

Good news:  she read over the parenting plan he gave me and immediately changed the primary custodian section from "shared every-other year" to solely me.  Said that even if it was only for tax purposes as he said it was we weren't going to throw him any bones. 

Bad news: she said we could file for spousal support but that she would be shocked if I actually got any.  We have only been married for two years and he doesn't make enough money for them to actually force him to pay me anything.  She did however say that we could try to bargan in a sense to try to get him to give me a little extra money while I finish school (I wouldn't be able to work for 5 months while I did so).

    I'm glad you got some answers.  I did not receive spousal support but they did make him give me several thousand dollars to use as a downpayment on a place.  So, as much as you won't be entitled to what you think of as typical spousal support, there are other options.

    Definitely don't throw him any bones. You use all of that stuff for bargaining chips!

    Well, unfortunately probably won't get anything like you did since I took half our savings, then when I caught his girlfriend hiding in the bedroom I took half of his half.  Not that it was much.
