Triggered last night!!..got fired today :(

Hi ladies,

it's been a while since my last post. I have my ER tomorrow Yay!!! but my boss just fired me for needing the day off and not being able to guarantee I won't need any more time off. So I've been crying for about an hour.  My boss is a cold hearted B*TCH otherwise I would have explained my situation. She already knew my days off were for medical treatment I just didn?t tell her it was for IVF. Wow I cannot believe how upset I am by this....

  • OMG - I am so sorry!

    Do you have any recourse? Is there an HR person you could talk to? You should be able to take time off for a medical reason without being afraid of being fired. This just doesn't seem right to me.

    But, the good news is, if you have it writing that her reason for firing you was due to needing time off for medical reasons, that has "please sue me for wrongful termination" written all over it.

  • Wow that is awful.  I'm so sorry.  I would definitely look at what your rights are in a situation like this because that doesn't sound legal at all.

  • :( I'm sorry that is just awful. I would be on the phone with HR right now, or better yet in their office. I hope you can straighten things out soon.

    It's been a long journey. TTC since 9/06. multiple IUI's and IVF's and 4 m/c's. IVF#3 = BFP, twins, induced at 34w6d due to baby b passing away (no explanation). Delivered on 35w1d, Baby A - baby girl, and Baby B - baby boy, our little angel.

  • I'm so sorry this happened. But the whole thing gets the side-eye. I remember when I had to be out when I was a new employee for medical things and I was reassure by a ton of people that it's not legal to fire you for medical reasons. Please talk to HR.

  • I don't have a HR department, I work well worked at a private practice  the only one above my manager is the doctor I worked with. I watched this manager fire another woman 7 mnths ago and twist the story to the doctor who took her word for it. She told me I was unreliable and they simply can't accomodate my being out for medical reasons. I got fired on the phone today! I am still in shock

  • I am so sorry about your employer.

    I would definitely look for a better company next time.  I am all about benefits and having the ability to take time off for medical reasons.  And your employers is too small for you to be covered by FMLA.  I am so sorry.

    But I do want to wish you good luck with the ER.

  • For the future, you can take FMLA (as long as your company employees more than 50 people within a 75mile radius of your office) for IVF.  These days can be taken consecutively or by the hour for example a dr appt.  You need to speak with your HR department b/c she can not fire you for this alone.

    I dont think they can fire you for having time off for medical reasons -- did you fill out FMLA. and you dont have to tell her what is going on because of HIPPA.

  • i'm soo sorry you wrk for someone like this but I would go to the dr directly and let em no that if they don't at the very least compensate u properly for firing u b.c of medical reasons then u will sue ... plain and simple ... it's not right at all!!

  • I am so sorry. It sounds like they are too small for FMLA and if you work in a "right to work" state, wrongful termination is REALLY hard to prove since either party can terminate the relationship with or without cause. That said, still apply for unemployment and if  if you get denied, appeal and write a statement  for the unemployment commission on how this was not fault-based. Many years ago I went through a shocking termination and getting the state's employment commission to say I was not at fault helped me so much emotionally, plus it meant I got unemployment (albeit months later when the appeal process was finished).

  • Eww, your boss sucks :(  I guess in a weird way, it's a good thing you dont work for her anymore.  But I'm sorry that it had to happen at all.  One word for your mean boss: KARMA!  What goes around comes around, she better watch out!
