Breaking the lease when husband joins

My DH and I currently rent an apartment with my sister and her DH. I know that the apartment complex will let my DH and I out of the lease when he joins but my sister and her H cannot afford the place on their own so will they be able to break the lease when we do?

    You won't be able to get them out of it. We tried to do this when DH deployed but they would not let our roommates out of the lease.

    Unless your sister's H also joins then no and they get moved somewhere.  Otherise, they need to take a look at the lease and see if it offers other conditions for it being broken or a fee to break it.

    The PPs are correct.  Your sister and BIL should speak with the management company though and see if they can down grade to a smaller unit.

    I think the only possibility here is if the laws for renters in your state is stronger than the SCRA.

    I used to be a leasing specialist.  If both of your names are on the lease and you applied and qualified for the apartment jointly then when you and your husband get off the lease they will have to re-apply and qualify for the apt on their own.  The management company won't want to risk losing a resident OR having to evict for non-payment (Eviction is a HUGE hassle for management)!!  SO, they should be able/willing to help them figure something out ( ie. moving into a smaller apt).  MOST places that I worked required a minimum monthly income equal to 3 times the monthly rent in order to be approved, plus the acceptable credit score, clean rental history, and no red flags on the criminal background check.  Good luck!  I hope this helps!
