NBR, do lemon laws exist on houses in Alabama?

Dh and I bought a brand new house when we got married back in 2007.  Well since then we've had some problems out of the house.  The way our house sits on the lot, it causes moisture/drainage to be a problem.  Our basement has had water running in it numerous amounts of times.  Nothing has been damaged, yet water runs in and then we have to sweep it out.  Well we finally got that part fixed by digging up the backyard and replacing the drainage pipe and making the pipe deeper.  We've also had to replace the condensor/motor in our a/c unit.  Our builder (who was a friend of DH's) has fixed most of the problems up to this point. 

Well now we've noticed some major issues with the house and aren't sure of what to do.  Our basement has water seeping through the blocks and our septic tank has been having pipe issues.  These are 2 very large things that I don't think we should be having to deal with right now, being the house is only 3 years old.  We've been trying to get this issue with the basement resolved for some time now and nothing has been done.  With a new baby coming, not to mention the threat of mold we really need to get this fixed, yet I do not feel like it's our responsibility.  Our basement has a 15 year waterproofing warranty, yet that company blames the builders for the poor drainage and when we try to contact the builders they just pass us on to someone else.  We're planning on fixing the septic tank problems out of our own pocket, but will be keeping receipts just to show proof of what the problems have been.

Sorry this is so long, yet I'm so frustrated I just don't know what to do.  Im just wondering if any of you guys have had similiar issues or what I can do.  We bought a new house so we wouldn't have to worry about these issues, yet here we are digging up the septic tank and trying to drylock the basement.  Any ideas/thoughts/suggestions would greatly be appreciated.  I don't want to have to sue the builders or any sub-contracters but we paid good money for this house and don't expect it to be falling apart yet.

  • Not sure - keep working w/ your builders - contact your realtor and maybe he/she can help?

     

    but... Alabama is a buyer beware state too :(   I'm not sure what all that means but it doesn't sound good.  I'm sorry you're having so many issues

  • Do you have a copy of your purchase agreement?  Most have a spot that says you are agreeing to purchase the house "as is".  The basement issue is something that should have possibly been caught by the home inspector.

    Unfortunately after continuous talking with the builder and the different contractors we have had to pay for a lot of the things out of pocket.  Like Christy said there was a clause on our agreement that pretty much got the builder out of fixing anything for us. 

    So our house is going on the market in the spring.  I told Wes that I didn't want to have to continue to put money into this house, and I was scared of what could go wrong next.  I don't want the hassle know what I mean?  

    I hope ya'll have more luck than we did and that it gets fixed!

    OH NO!!  I'm sorry that you're having so many issues out of your house, however I definitely can relate.  I'm going to look over our purchase agreement, but I found the builders limited home warranty info and I believe that's going to let him off the hook of fixing anything.  I'm with you, we're fixing these issues then the house is going on the market, I definitely do not want to deal with it. 

  • I don't have any advice for either of yall, but just wanted to say that stinks! I would never imagine you would have so many problems with a brand new house... you've had more problems than what we've had with our 60-year-old house.

    Good luck. Hopefully you can get someone to pay for the basement repairs!
