What is so hard to understand CW?

We have a top candidate for a job.  He doesn't want us to contact his current employer until the background check is done just in case. He is contract and he is worried they will fire him if they find out he is looking at other jobs.  I think it is understandable.  We have called all his other references and they have been good.  CW is in charge of the hiring and she said "but we always contact the current employer before doing a background check, even if the candidate doesn't want us to".  WTF.  Run the damn background check, then we will get the last reference before offering the dude the job!

    TTC #2, Operative hysteroscopy March 2011; IVF #1 long lupron protocol April 2011-cancelled due to poor response; IVF #2 flare protocol May 2011=hospitalization due to abdominal hemorrhage during ER and no fert due to MFI issues. Moving onto international adoption from Moldova January 2013!

  • Apparently her problem is that if this guy does come back with a criminal background, she has to submit his references to a committee to review.  I just can't see the committee not understanding this guys situation.  This cannot be the first time that they have had this happen in the years HR has been doing background checks like this.

    Although, I would hope you could sue if someone notifies your current employer when you asked them not to and it results in you being let go?

    As a full time employee, you should be able to sue for wrongful termination.  As a contract, you don't really have a leg to stand on in a suit.
