We have a top candidate for a job. He doesn't want us to contact his current employer until the background check is done just in case. He is contract and he is worried they will fire him if they find out he is looking at other jobs. I think it is understandable. We have called all his other references and they have been good. CW is in charge of the hiring and she said "but we always contact the current employer before doing a background check, even if the candidate doesn't want us to". WTF. Run the damn background check, then we will get the last reference before offering the dude the job!

This is why I am VERY nervous about putting my current employers info on job applications.
Although, I would hope you could sue if someone notifies your current employer when you asked them not to and it results in you being let go?

As a full time employee, you should be able to sue for wrongful termination. As a contract, you don't really have a leg to stand on in a suit.
