For those whose kids have gone to Private Kinder in Daycare

My son does not meet the cutoff, so he will have to wait till 2011 to go to Kinder in Public School, so right now he is in preschool and next fall will be in private kinder at daycare. So does your child have to take it again come Sept. 1st  since the TX law says day have to be 5 by SEPT 1. Does anybody know?

    Most likely yes since he also wont meet the cutoff for 1st grade at that point.

    Your child has to be 6 by Sept 1 to start first grade.  The second year in kinder won't hurt him; but if you are really against it many districts offer an option to "test out" of kinder and be placed in 1st if you don't meet the cutoff.  If you are going to go that route I would recommend making sure your private kinder is accredited by the Texas Education Agency (TEA).  Many daycares are "accredited" but not necessarily by TEA.  Your local school district administrative office can provide more information.
