dh started an s corp on dec 14 2009. For most of the year he was self employed. Does he need to file for the s corp for 2009 even though the corp made no money in 2009. He says no I say yes.He thinks our personal return is finewe live in nj
Just IMed DH who is a tax accountant. He says yes. Then again, I'm just a random bumpie, so my personal advice would be to call your accountant. Better safe than sorry!

yes anything that happens during that year has to be reported...if you get married in dec or have a baby on new years eve...your considered married the whole year and the baby is a dependant the whole year

This. You can't just not file and say you made no money, the government won't believe you. I would call the IRS tomorrow and just explain...they may let you still apply for an extension (with a fee).

I would file it. The setup cost are still a deduction on the self employed income. The IRS website is really good too.
