Hi all !!
I was wondering if any of you have come across the same problem as I have. Per FMLA you can take up to 12 weeks time off. This can be either during ( for morning sickness ) and up untill after pregnancy it is up to you. The process is supposed to be easy all you have to do is file a intermittent claim with Metlife and have your DR. fill it out.
I did this and took it to my Dr. but she says she will not approve any intermittent claims only long term and it is up to me to figure out what to do. I have used all my sick time at work and dont know what to do now. I really like her other than this FMLA thing. Is there a reason why a DR. would bot want to fill it out?? Do they not get paid??
Re: FMLA
That is very interesting that she won't fill it out for intermittent. Did you ask her what happens if you go on bedrest? Or why she won't approve it for both?
I am sorry I am no help. I did not have this problem. I don't remember the form saying anything about intermittent or long term. My employer just allowed me to use it for both.
I would talk to the doctor and look more carefully into FMLA - find out what work is obligated to offer you.
Honestly, a lot of doctors don't do intermittent claims because it's a huge way for people to abuse the system. It's not necessarily fair or right, but some doctors don't want to get stuck in the middle of what could be fraud. It sucks for people like you who want to use the time for legit reasons.
Is this an issue with morning sickness? If so, talk to your doc and tell her that your sickness is so bad that you are missing work. She should prescribe you something to try and help with it, if she hasn't already. If it's not related to morning sickness, then I can totally understand her hesitation to complete the form.
Just read the FMLA paper posted at work, this is what it says:
Definition of Serious Health Condition
A serious health condition is an illness, injury, impairment, or physical or mental condition that involves either an overnight stay in a medical care facility, or continuing treatment by a health care provider for a condition that either prevents the employee from performing the functions of the employee?s job, or prevents the qualified family member from participating in school or other daily activities.
Subject to certain conditions, the continuing treatment requirement may be met by a period of incapacity of more than 3 consecutive calendar days combined with at least two visits to a health care provider or one visit and a regimen of continuing treatment, or incapacity due to pregnancy, or incapacity due to a chronic condition. Other conditions may meet the definition of continuing treatment.
Not sure if this helps, but maybe your doctor doesn't consider morning sickness serious enough to grant you leave. I agree with PP, you should talk to your doctor about treatment if your m/s is so bad that you are missing work.
Employees can take FMLA to care for their "serious health condition." If your physician doesn't believe that your morning sickness is considered a "serious health condition," than she is correct in not completing the forms. Unfortunately, her completing the forms against her medical judgement would be considered fraud.
I think rather than discussing FMLA with her, I would discuss having her perscribe something for the m/s.
Feel better.
