Maternity Leave??? so confused!

Hello Ladies!

 I'm incredibly confused about the new Family Leave regulations and policies. I work for a large company where I get 4 weeks before my due date and 6 weeks from the birth. That wasn't enough time when I had my first son but he was born before the new paid leave so I have NO clue how it works. Can anyone tell me how they worked it out with their companies?  When did you file for the FLI? During the last few weeks of your regular leave? SOOO confused!!

  • When I called to report my upcoming 1st day of leave, I was mailed a packet that included a certification I had to fill out for FMLA.  I don't think I got anything for the state leave - it won't apply to me as my disability is actually longer and more generous.  I'd call your HR and ask them what paperwork you need to fill out and when. 

    Whether FMLA runs concurrent with your company's leave or is tacked onto the end is up to your company policy.  Not sure on state.

  • I can only speak about how it is done with my company, but... 1. You have 12 weeks of unpaid leave under Family Medical Leave Act (FMLA).  During this time, you may file for state disability (which pays $561/week for the amount of time your doctor declares you disabled). This will require completing the form at https://lwd.state.nj.us/labor/index.shtml (you will complete a section, your HR Department will complete a section and your doctor will complete a section).  I am not certain how your own company's payment factors in.  For ours - they offset the company payments by the amount you get for disability. Typically, they declare you disabled for 6 weeks if you have a natural birth and 8 if you have a c-section. 2. After the 12 weeks of FMLA, as long as you are no longer disabled, you are eligible for NJFLA (New Jersey Family Leave Act) which gives you an additional 12 weeks of unpaid leave to take care of someone other than yourself (your baby). During this time, my company requires us to use sick/vacation/personal time to receive payment otherwise it goes unpaid. 3. Once you are no longer disabled (be it under FMLA or NJFLA) you can file for NJ Family Leave Insurance, which gives you $546/week for up to 6 weeks. The labor website (above) will have those forms - they look very similar to the disability ones - though it does note that if you filed for disability due to pregnancy, they automatically send you the FLI forms. Pregnant women at my company said that the turn around time from sending in the form to receiving the first payment was generally 2 weeks.   I hope that helps!
  • the way it worked for me:

    4w before birth under STD (i had more b/c of health issues) fully paid with STD.

    6-8w fully paid after birth (vag or c/s)

    THEN the 12w FMLA leave unpaid started...

    during that unpaid time i filed for the new NJ family leave pay - and got partial pay for 6 weeks.
