  It varies by state, but the first step would be to hire an attorney that specializes in step parent adoptions.  It Utah you have to live together for 1 year before it can be finalized.  Before that one year is up your attorney can send the bio dad paperwork where he relinquishes his rights.  Then you file a petition to the courts to have the adoption finalized.  In our case bio dad didn't sign the relinquishment paperwork so we had to do a couple of other things, a judge ended up terminating his parental rights and finalizing the adoption on the same day.

  You may have to go backa page or 2, but there were a couple of posts a couple of weeks ago some peole commented on. Might want to look there. I think that the major thing is BD's rights will have to be terminated, and they don't term rights without proper notification. even if BD isn't in the picture, once he is notified he will either give them up with no fight, or suddenly want something to do with the little girl, and may put up a fight. I don't know your situation, I just want you to be aware that it might stir up issues and he might make it difficult. GL

  I'm trying to navigate this process too. I just got married last month. My 11 yo dd's father is deceased bit never had anything to do with her while alive really. I'm having a hard time finding info specific to SC so I'm just going to hire an attorney
