What did you put in your divorce agreement?

is there anything you wished you knew as you were making the agreement, anything you are glad you put in or wish you put in?

I am meeting with a lawyer tomorrow to draft up our agreement so I'd love your input!

  • Make sure the court reinstates your maiden name if you intend to return to it; otherwise it is another fee/lawyer to change after the fact.

  • I put a clause in there that exH would have visitation on the weekends he is off of work.  My ex works (well worked, since he just got fired) a 24 hr shift and I didn't want the kids visitation time to be spent with babysitters.

  • We have that our child support is recalculated every year based on our incomes and child care costs. That way we don't have to go back to court every time it needs to be changed.

     THAT'S SMART! I would have never thought of that.

  • The lawyer told me this would be in it. I didn't ask, and he made it sound as if it was just the way it goes:

    Since I am paying for health insurance, any out-of-pocket costs (not including co-pays) over $250 would be split between us.

    I claim the kids on my tax return.

  • -he carries health insurance for N.  Anything over $100 we split according to our income ratio (54/46) not 50/50.

    -I get all tax rights.

    -N has to have his own bed when staying the night at his house.  This makes is clear that he is not to be sleeping with him, family, etc.

    -Future medical costs (glasses, braces, etc.)

    -Be very clear on parenting time.  I am currently going back to court over telephone access to N when he is with my ex because ex is a d-bag and cannot use common sense.
