WWYD:FMLA??

I took business law so I am informed enough to know that our company is big enough to qualify, not by much, but they are.  My boss has been very good about me going on leave and said to take 8 weeks (or however long) and not to worry about, to which I informed her that 6 weeks would be enough. When I asked our Payroll/HR lady about filling out the FLMA forms she said she didn't know anything about them and that I don't need to fill anything out, just call and let them know when I will be released and want to come back.(she is 67 and very old school) I thought about e-mailing my boss so that I have a valid record of asking to fill out the forms and then just let it go. WWYD?

    I agree they're pretty standard i would think there is a government run website you can get them from if your job doesn't have them.

  • The most important part, as far as I understand, is having your doctor fill out the form that justifies your FMLA (your employer would typically mail this to your doc upon your notification of taking FMLA). The form is at this link, and this should be a good start to find something for you to give your employer.

  • Your employer has to have 50 or more employees within 75 miles so even though your company might be big enough, if you have people spread out in different offices, you might not qualify. If you do though, I would fill out the forms and give them to her. FMLA in 09 changed and has very specific obligations for employers (Notice of Eligibility forms and Designation forms) so hopefully your HR lady will get on top of it!!
