DH called her one last time last night and left a really nice message checking on the status of our refund. Right when he hung up the phone rang and it was her (caller id)!! She asked who it was, he told her, and she hung up on him!
We are filing with small claims on Monday. We have our statement, receipt and cashed check all ready to go so all I have to do is drop it off and pay the $30.
I really want to do it today but we'll give her until then to send the money. You'd think we would have learned our lesson by now

Yep it is...but she left town...I'm REALLY glad I never had my kid with her now. I am hoping the PO knows where she is because I'm sending the judgment certified mail to the address she was at before she left 6 weeks ago.

Honestly though if pp is correct and she backed out on you for the care then she probably does this all the time. Tells someone she'll watch their child, takes a deposit, and leaves! Well I hope they find her for you and you get your money back. I've also never heard of an in-home provider requesting a deposit though so I wouldn't do that again. Good Luck.
The ironic thing about that is she had us pay 2 weeks upfront so we couldn't run out on her on the last day he would be there because that had happened to her before.
