My boss sucks! (Vent)

So yesterday was DH and I's 2 year anniversary... everything was going great in the morning until I get to work.  My boss calls me into his office and tells me he can no longer pay me while on maternity leave.  A few months back, we agreed that he would pay me while at home so that I can do some work and keep my job running so the company doesn't fall behind.  So he says yesterday that lawyers and the insurance company told him that he can't do that because if something happens to me or the baby while at home I can sue him because I will technically be on work time.  I told him I would sign any legal document saying that wont happen, he said they told him that they can't draw something up like that.  What a jerk! I was planning on using my vacation days around the holidays, so I technically only had 2.5 weeks left here.  Nice right? We are waiting to close on our house, and I told him that we might not be able to go through with it now because of this.  I planned my next few months based on the fact that I would be getting paid.  He tells me that I am guilting him.... no... I'm telling you how it is.  We are a very small company, family owned, and I have been here for 7 years.  I respected him and he respected me, we had a great working relationship, he would confide in me on a lot of business issues etc.  Now I am just so disgusted that he would do this.  He also said if money is a problem, I guess I would just have to come back to work sooner!?!?! REALLY? I planned on taking 12 weeks and thats what I am going to do.  Somehow we will make it work, just thought I would get that off my chest.  Sorry for this being so long!

 Also, does anyone know the percentage of pay NY short term disability covers? I have to start filling out all that paperwork now and I don't know where to start!

  • I'm sorry your boss is a jerk for going back on his word like that.

    That's great that you're taking 12 weeks off. I asked DH if I could take 2 months off (5 weeks paid, 3 weeks unpaid) and he said no. We can afford to have me at home for the time I would be paid. So after the c-section I will be off for 5 weeks then back to work. With my son I was off work 4 weeks from a c-section and then back on patrol. It's not something I wanted to do but it was something I had to do. I know how you feel depending on the income to make the family work.

  • I'm sorry that you're having to deal with a change in plans, but I think you're also failing to see your boss' side.  I'm a business owner, and he's not being a jerk, he's being a business owner.  Small businesses are very vulnerable.  You're lucky in this economy, honestly, that you're not just getting laid off.

  • That sucks.  I hope you and your DH can figure out a way for you to take off the full 12 weeks.  I'm not an employment lawyer (although I am a lawyer), and I'm not buying the explanation he gave you.  Under that rationale, nobody would ever be permitted to work from home.  I think it sounds more like it's a money issue and he's hiding behind the lawyers and insurance company.  Good luck.
  • I'm very hormonal because I'm practically in tears reading your post. That really does suck. I can't imagine how infuriated I'd be, especially considering your long and close relationship with your boss. I hope you're able to work everything out with the closing and with your job. Try and put it on the back burner until after the holidays, and just relax and enjoy your family.
  • I don't know the percentage, because there is a max and I max it out.  I do know that in you have a c-section, you get paid that percentage for 7 weeks (weeks 2-8) and if not you get the disabilty for 5 weeks (weeks 2-6).

    It sucks that he is changing his mind this late in the game after you've already made plans based on that.  Lots of people work from home (including me), so I guess I don't understand how it's not a liability issue for more companies.  If I fell down the stairs on my way from my office to make a cup of tea or to throw in a load of laundry I can't imagine sueing my employer.

    This seems harsh.  I think OP's 7 years of service and her willingness to do her job remotely while on leave indicate that she's a valuable asset to the business.  There's no indication in her post that her job is no longer necessary (she says she's going to do some work so the business doesn't fall behind).  So, I think it sounds like it's in the business's best interest to work something out with her rather than go through the expense (and risk) of replacing her and training someone new.  I know those costs are quantifiable and the general business sense is that it is cheaper to keep people than to replace them.

    Honestly i would request that I get laid off, at least you could collect unemployment.

  • Sorry you have to go through that. It does sound like it's a money issue, b/c he could have said that he would pay you either way.

    I don't live in NY and don't know what the differences are, but you would have had to have short-term disability coverage before your pregnancy to collect this. I know at my job we get 70% of our month salary. For us it's our workplace that provides this in our benefits package.

  • Companies suck, that's for sure.  I'm not a lawyer, but I have to agree with the lawyer in that his reasons don't quite sound right.  And, even if you did get hurt at home, it should still be covered under the worker's comp policy.  I'd review the benefits plan again, and look for a new job in the mean time.  One with better benefits.

  • That really sucks...sorry you're having to deal with it. Isn't that a bit of short notice to inform you of this when you're nearly full term??
  • Wow, that does really suck.  I'm so sorry for you!  Did you elect for STD before you got pregnant?  If not, you may not be eligible.  I hope you are though.  I'm in FL and here we get 60% of our salary.  But, we have to continue paying our medical so it ends up only being like 40%.  The whole thing is challenging no matter how you look at it.  I was feeling sorry for myself that my boss wouldn't allow me to work from home after the baby is born, but now I feel worse for you.  We're lucky to have jobs, yes, but that doesn't mean we can't still feel badly about our own personal situations.

    Good luck with everything!  I hope you can still make your 12 weeks work and show your boss!  :)

  • I don't think you can apply for STD when you are already pregnant as it counts as a pre-existing condition.

  • NY gives everyone who's working STD for pregnancy...If I recall correctly, you don't apply until you actual go out.  You could have bought additional private STD insurance before getting pregnant...and that has the pre-existing condition clause.

  • Thanks everyone for the responses! Yeah, in my opinion it would be in his best interest to keep me working b/c the company will fall behind and homeowners will get pissed.  I work for an environmental firm and do soil, and groundwater sampling as well as the state reports for the NJDEP for contaminated sites, mostly UST removals.  Homeowners and the NJDEP expect those reports in a timely matter, especially if they have a closing.  For the state of NJ you need to be licensed in order to do the reports, and I am the only one here who is licensed besides my boss, but he's the owner of the company and has never done the reports before because, obviously, he never have to.  So there will be a 12 week backup on reports when I get back, does that sound fair? no.  But oh well, it's not my company.  I already started updating my resume and I have a few fall back companies that I could go to if needed, but this place was conveniently close to home.  So we shall see! My current feelings towards the company is really making me not want to come back here after our DD is born.

    Wow.  My doctor requires 6 weeks off for a vaginal birth and 8 weeks off for a c-section.

    I work for a small company that doesn't qualify for FMLA...but as soon as I found out I was PG I stashed all of my accrued leave (I accrue 16 hours or 2 days a month) and saved up the remaining time I had from the previous year (my hire date is June 1 so anything not used by then was forwarded to this year's "pot") so I'll have 506 hours to use for leave.

    I have not heard of the lawsuit potential that the OP says her boss is using...I plan to be off fulltime for 8 weeks and then work from home part-time and in the office parttime for the next 10 weeks.  I might double check that law he's quoting about you being able to sue if you or the baby is injured at home while you're working.

  • I call a big fat load of B.S. on his reasoning that you could sue him if you got hurt at home. LOTS of ppl work from home and there ARE forms you can sign to not hold the company liable.

    My family owns the company I work for and I am taking 6 months off and working from home. So I know 1st hand paying you should NOT be a problem.

  • I work for a privately owned company and I don't get paid for maternity leave.  He should have told you from the get go that because that is how most smaller companies work.  Anyway, I have to come back after 8 weeks because financially I can't take 12.
