I think that last statement is a bit harsh. She might have been completely clueless and I am totally guilty of doing this once. I'm sure she didn't INTENTIONALLY put her baby in the carseat unbuckled with the intent on getting into an accident.

The first responder must have missed the front seat part. Hopefully it was just dark and you saw it wrong. Maybe you can watch for it another day or privately raise the concern to daycare if they might have a better opportunity to check it out. I wouldn't accuse them, just mention they may have forgotten and could someone check it out.

DS's dad's sister does this with her 3 year-old daughter. I called CPS and they said they can't do anything unless they actually see it, or she admits to it. She's 30 lbs...and tiny. She either puts her in the back seat and lets her jump around, or she puts her in the front and might put a seat belt on her. Makes me mad everytime I see them somewhere.
