Okay ladies I'm completely in the dark about all of this. I haven't worked since the end of August (I worked p/t & was in nursing school.) I've worked p/t for a long time & I'm wondering if I can file for the FMLA? I really have no clue about any of it so any info is super helpful! TIA!

You have to have worked a total of 1250 hours in the past year (and have been with the same company for the past year)... as far as I know...
At my job your not covered by FMLA unless you were full time for a year. I will fall a month a 4 days shy of a year by my due date!! They dont even have to offer me my job back after i have LO, and I dont get any PTO. They are a joke anyway. My job is all about itself and dont give a damn about anyone but themselfs and making money!
Check with your HR department, but my understanding is that FMLA only applies to employers with 50 or more employees. In order to be eligible you must have worked for that employer for a minimum of 12 months and for at least 1,250 hours during the previous year. Also check into your state's laws. I believe California has some sort of FMLA equivalent that might apply to your situation.

Maybe I'm reading your post incorrectly, but if you're not working why would you file for FMLA?
FMLA provides for an unpaid leave up to a maximum of 12 weeks. You generally must have worked with your present company for 1 year before becoming eligible and 1250 hours in the 12 months preceding the start of the leave.
I think you may be confused. FMLA protects your job when you have a baby so that you can return to work when you're ready. It doesn't pay you for maternity leave.
But in CA you would probably qualify for short term disability benefits from the state. I believe that you have to have paid social security taxes to get the benefits.
Call CA disability and ask them. When I had DD I qualified, and I have't been working at my job for a year. But I had been paying into the system. They were really helpful when I called and the forms were pretty easy to fill out.
