NBR: Grrrr! Pregnancy Rage and Gift Certificate!

Having extreme bouts of rage here over something relatively small!

 

DH and I were given a gift certificate to a local restaurant (not a chain) in our town this past christmas for $50.

We were going to use it last night, pulled it out and saw that on the bottom of it it states "Expires Three months from Purchase Date."  We were both pissed because Gift certificates are not allowed to expire in California.

We called the restaurant and he said that he had never heard of them not being able to expire, he would not accept it.  Later he backed-down and said he would accept it but would only give us half ($25).  I refused!  I went online and on the State of california Deparment of Consumer Affairs, it says "Restaurant gift certificates good for meals cannot have expiration dates.  Restaurants issuing gift certificates, either directly or through affiliates, must accept the certificate even if it's an older certificate with a posted expiration date, if that certified was issued after January 1997."

I called him back with that info and he still refuses to accept it!

What do I do? I know it's small but I'm really mad!  Even if expiration dates were allowed, and they're not, it's such a rip-off to have them expire three months after the purchase date!

  • Sounds like a class action law suit as well...so if you know any lawyers, present it to them.  If it's a smalll restaurant, they might not be interested in persuing a case, but they maybe willing to back you to at least get your $50 meal.

  • If there is a higher authority, call that person. If not, contact teh Attorney General's office. Get a letter and take it down to the restaurant. You may not get your GC redeemed, but you may get your point across. Nto to mention now the restautant is on the radar of the state. Always fun.

     

  • I would print out the regulations from the website and bring it to the restaurant with you, and definitely alert the BBB. How can they "not know"?
  • I'm not a lawyer and I'd be super pissed too. How agrivating!

    However, I did note when I was reading what you posted that the wording was "certificates good for meals" that may be different from a dollar amount. I don't know if that has any impact on anything but thought I would point it out.
