FMLA

I'm so confused! All this time I assumed that I would get paid through the government for my 6 weeks time off to take care of my baby. I was on the DOL website and was reading up on this. I'm getting the impression that this paid time off is not so.

Can anyone help me out with this? Is the FMLA just a guarentee that you won't lose your job for taking the time off or is there also a way to get paid time off through the government... at leat partial pay? I know my employer can't afford to pay for my time off (she's my mom, I do my parent's bookeeping for their automotive repair shop). How does this really all work?

  • FMLA just secures your job, but I'm pretty sure the state of CA gives paid disability for pregnancy.  Most other states don't do this, but I think CA does.  Check into it with your HR department.

  • FMLA only guarantees you have a job to return to after up to 12 weeks off for a qualified reason (per 12 month period, in a company with a certain # of employees, and if you've been there at least one year with a certain # of hours clocked). You are not paid for this.

    Maybe try calling around your state government offices then.  The company I work for has a lot of employees in CA, and our employee handbook has all these special sections just for CA employees explaining that they are eligibile for disability through the state.  We don't get that in WI though, so the employer pays for short term disability insurance for us.  GL.

  • FMLA only guarantees your job, not your pay for the time off. You should have gotten short term disability for this but if you are pg, it is too late. Sorry!

  • DH took time off in CA under the EDD department  called Paid Family Leave- he got 55% of his salary.

  • Apply for SDI, your doctor should have the forms. Once your SDI is over they will send you a form and you can get 6 more weeks of paid leave for family bonding.
  • Thank you SO MUCH for posting this! When that form came I was so sleep deprived I didn't realize what it was and filed it away! Just filled it out and hopefully it will go through with no issues. Wow- six weeks of pay I almost missed out on!

    If there aren't 50 or more employees within 75 miles of your office, FMLA may not apply at all.

  • After hours and hours of reading up on Short Term Disability and Paid Family Leave in CA, I came across this site and they summarized it pretty well:

    I work in a small company too so had to figure out all the leave options myself.  I just printed out and filled out the Short Term Disability (SDI) forms from here: https://www.edd.ca.gov/Disability/  Then gave it to my dr's office who signed off.  On the first day of my leave, the dr's office called me to confirm what day I wanted to start my "leave" and submitted the forms for me.  

    The first week of SDI you don't get paid but you are allowed to use your accrued sick or vacation time to cover.

  • By the way, I'm taking off 4 weeks before my EDD, 6 weeks off after (for vaginal delivery or 8 weeks for c-section) through SDI and then immediately taking Paid Family Leave for another 6 weeks after that.  The amount you get on PFL will be the same as SDI.  Woohoo!  You will get around 55-60% of your pay, tax free.
