SSI ? Any suggestions?

My youngest son Hunter (9) was diagnois with CP when he was 2. I filled out all the paper work to see if we would qualify for SSI for him. A year later he was approved. It went by mine and his dads income (we are now divorced).

Bringing you up to date. I got remarried in September. I called the SS office to let them know about my new husbands income ect.. In October I recieved a check which I called the office and asked about it since our income almosted doubled. They informd me yes that it wasnt an error. So I did. November came and same thing. I called again with the same concerns and they told me the same thing. Each month I would have to mail in our paystubs for the month. So each check I got was a differnt amount but still I thought we wouldnt get  SSI payment  cuz we made over the income guidlines.  December came and same thing just that the amount was differnt, Called again and was told the same thing. That it wasnt an error.  January came saying we wouldnt get a check cuz we were over the income guide lines. (which is fine) Then a week later got another letter sayine that they Overpaid us the last 3 months and we have to pay back all the money. Which was used for his needs. I called talked to the same person and asked for a form to fill out its called a waiver for repayment.  Got it in the mail filled it out and mailed it back. Never heard a thing till this past tuesday. I got a called from the SS office and was asking me about paying it back. When I asked about the wavier They never recieved it so Im back to square one and have to fill it all out again.  UGH!!! 

Has anyone delt with them. Do you know if I am going to have to pay it back? I did everything they asked me to do each month so its their mistake? Or am I wronge for feeling this way? Any sugguestions??

  • UGH!!!! I am just in the process of reapplying after denial.. so no advice.. but that is AWFUL!!!!! I'm so sorry - but I totally agree with how you feel!

  • You will have to pay back the money if they do not accept the waiver. SSI is behind and it all catches up at some point. Even calling doesn't help, they will set up a payment plan with you to repay the money due to over payment. I would try resubmitting and going from there. It's a long process but you have to keep trying. I used to send in DS dad's check stubs every two weeks, and would have to send them a few times before they were actually received.
  • i dont know a whole lot about the application process. can you fill me in? DS gets SSI because of his low birth weight until he is released from the hospital and then we will be re-evaled. i dont even know what kind of salary cut offs they consider......ours has just dropped by half becuase i no longer work (given ds' condition) but i dont know what they consider "making a lot" my dh is in the military and we have good benefits so im not sure and i dont even know what he would get if we qualified. any info you could give would be great! tia!
