So yesterday DH talked to the landlord who said he had no idea what was going on and that this was the first he had heard about what was going on. He also said that he was making the mortgage papers.
After reading the paperwork the cop gave me yesterday I discovered that the landlord hadn't paid the mortgage since a few months before we signed our lease.
He was $2803 in default as of February 17, 2009.
DH called the cop who brought the paperwork to me yesterday and found out the landlord would probably be served papers today. The funny thing is, he is a sheriff as well, so more than likely his boss or one of his co-workers will be serving him the paperwork.
DH also tried calling the bank where the loan is at to find out exactly how much is left on the loan so we could possibly look into getting a loan (my dad said he would help us out with this), but the person at the bank said they couldn't discuss this with us since our names aren't on the loan. So now DH is supposed to talk to the landlord to get that information.
Sigh...what a bumblefvck mess this is. Thankfully we have an appointment for Wednesday with the lawyer so maybe we can get some help from him.

I think it varies by state, but as tenants in the house, I *think* you might have more rights in terms of purchasing the property. First right of refusal or something like that
