And no, I am not even sure where I lie on the drunk driving laws or these laws, just wondering what you guys think. My sister had 3 DUI's. She almost killed someone on the last one. I think she should have gone to prison WAY LONGER than the 9 months she got. She only recently even started to feel bad about it, she thought it was "no biggie".
I do, however, think parent who has a child die because they are improperly restrained does deserve jail time, even if they didn't cause the accident. And no I don't think losing their child is punishment enough.

I do not agree with this at all!! Not one bit. My dh and I made a mistake ONCE and didn't buckle DD in on our way home from the store. We bought something that we couldn't fit in the car, and each of us thought the other buckled her in. I was a mess over it- and nothing happened. Are you seriously telling me that I would deserve jail time if, God forbid, something would've happened to my daughter because of that mistake...when her very attentive father and I were both there? Seriously? Nothing even happened and I beat myself up over it- I....I don't know. I can't believe you'd make this statement. I'm not flaming- honestly, I'm just taking this personally and it makes me feel sad/bad (I'm PMSing OR I"m KU, so my hormones are out of whack today...maybe I'm overreacting)

If there are laws against cellphone usage while driving, then yes. Some dumbass young teen nearly hit me head on last week when she swerved into my lane. She was texting.
As for the other... I guess its what you define as properly restrained. Not restrained in a seat at all? The shoulder straps too lose? IDK. I can buckle Adam in, but he can still houdini his way out of his seat.
I totally agree. I've come very close to being hit (with DD in the car) several times by people who are obviously texting.
The laws on the books are wholly insufficient. Virginia finally passed a weak one and many states don't have them at all. I saw a segment on the Today Show last week - a man was killed by a teenager texting while driving and she got a traffic citation because texting while driving was not legal. ???? I hope they at least sued her arse in civil court.
I think it would be hard to meet the burden for a murder conviction, although I don't think manslaughter is sufficient either. Vehicular homicide maybe - I don't know all the 'categories.' People texting and such while driving is a huge concern of mine. It's bad enough to drive and talk, but to drive and text??!!! WTF! Don't do it. There needs to be serious punishment one way or another.
That is the issue for me. What you did was make one mistake you feel horrible about. But should a person who has NO carseat when they are available free everywhere, or someone who holds the kid on their lap in the front seat and their child is killed not be punished? Should a person who has their 3 month old front facing not be punished if they get hurt? Should the person who has their child RF in the infant seat in the front seat with an airbag not be punished?
