Need nestie help--is there any way a tenant can find out...

...if the house they're renting is in danger of being foreclosed upon??

I posted below that our landlady asked us last night to pay TWO months worth of rent this month, which is assinine, I realize and we have NO intention of paying it, but she asked for it, she said, because she's behind on the mortgage.

I don't know if the mortgage she's referring to is on the house we live in, or one of her other houses (she owns several in the area and in England). ?But I am FREAKED out that the sheriff is going to knock on our door some day and evict us b/c the house is in foreclosure. ?

Aside from that just being an awful situation in general, it would be utterly humiliating b/c not everyone in the neighborhood knows we're renters---I'd hate for people to think that we defaulted on a mortgage, when we've been paying our rent all along (and paying a mortgage on our own home in VA).

So, is there any way I can find out, aside from asking her directly, if our house is in danger of being foreclosed on? ?

  • in my area, they post them in the legal section in the newspaper so the courts must have them on record.

  • Do you write your rent with a check? Find out which bank she cashes it and then call the bank and tell them the situation. Be sure to mention, that you don't want to be evicted with a young kid.

  • Check the auditor's website for the county you live in.  If the property is in her name, it will have the name of the bank that holds the mortgage and you can call them and find out if she is in foreclosure on the property.

  • In our county (in TX), you can go onto the Tax Assessor's website and view tax bills.  With a little digging, you can find out which mortgage company pays the tax bill.

    The mortgage company will not tell you, that is private information. There is nothing you can really do other than watch the paper and ask her point blank.

    There are tenant rights though, look them up in your state.

  • I know there is a website that lists homes that are in forclosure, not sure the site but a friend told me about it.

    Shame on her for not being up front with you. Yes, its sad that so many people are in trouble, but you and your family are innocent victims here. I would ask her point blank as Mel said.
