Have you created these documents? My husband is in law school (graduates in less than a month) and is going to write these up for us tomorrow. He said you do not need to have an attorney to do these or even to do your will/trust.
I did, but I am an estate planning attorney so it was easy for me to create them for myself. Your husband is right - you do not need to have an attorney - but I think it's advisable to use one for your will. At the very least, you should get an attorney to at least look over what you've done.
I have a healthcare POA for my kids since my husband is gone. If something happens to my kids while I am at the hospital or whatever, my friend can get them taken care of. I do not have a living will or healthcare POA for myself though. I should but I don't. I have seen first hand what can happen if you don't have your wishes written out legally. My grandpa did not want life support of any kind, we all knew that but he did not have it official so when my grandpa let him get put on life support, he was not happy. So he lived his last days unhappy.
All we have are our regular POAs so I can handle everything without my husband and he has a will since it is required for him.
Advance Directives such as HC POA and Living Will can be dowloaded online in Ohio. I assume the same would be true in most states.
My husband plans to go into estate planning... he has like 4 wills, trusts, estate planning/drafting classes this semester. He actually downloaded the OH forms today and said I needed to just fill them out and he'd look at them with me. I was asking him about the will/trust issue and he said we didn't have anything to fund the trust, but I think a basic will would be ok to have on hand.
