She hit a bike rider with her SUV. She said she never even saw him. So awful. He was 54, wearing all the biking gear, helmet etc. His injuries were still fatal. She hit him with the left side of her Explorer....I don't get it
That is seriously one of my biggest fears. When I worked overnights and had to drive hella late at night or early in the morning I would imagine what I would do if something like that happened. Poor thing, I bet she is going through hell right now.
DH is a wreck, I have not talked to her. She has never really talked to me so I left it to him. I just told DH to tell her to lawyer up and send the man's family her regards. I am kind of numb to his fam. They never came up or really supported us during the losses of our 1st twins and son. I am going to pray, because I am not cold, but just numb to a lot of people. I feel awful for the man's family. I am evil...

VIRGINIA BEACH, Va. - Police identify him as 54-year-old Daniel Wayne Hersh of the 2300 block of Windway Lane in Virginia Beach.
WAVY.com learned early Sunday morning that a Ford Explorer, driven by a female, was traveling eastbound on Shore Drive when the right side of her vehicle struck Hersh.
He was transported to an area hospital and was pronounced dead at approximately 9:00 a.m.
The case is still under investigation; however, alcohol and speed do not appear to be factors. At this time no charges against the driver of the SUV have been filed.
The accident happened in the 3000 block of Shore Drive near the Starfish intersection around 5:45 a.m.
DH says she is a wreck, not him...sorry...he is concerned. I wonder will she get time? I think his family might sue....it was dark out, but he had on reflectors and all.
I don't think you're any less "evil" than I am for having no sympathy for HER(only for your family, because you will all be dealing with this, too). Just because you know her doesn't mean you should feel sympathy for her. She hit and killed a man with her car and didn't even see him until the deed was done. That doesn't garner sympathy from me I'm sorry your husband is upset over it. Try to seem sympathetic, at least towards him.

How do you hit someone with the side of your vehicle though? Was she going down the road and he ran his bike into her side? I don't get it! If it was an accident and they're not charging her how can they sue her? Sorry about all the questions, I just don't understand.
Yeah...I am talking to him. It is really sad, and I am sure he life has forever ben changed. I just wondr does the man she hit have a family, or children.....it is just awful anyway you slice it.

Something similar happened in my neighborhood late last year, I believe the person on the bike was crossing and there was no crosswalk and because of the hill and other factors it was ruled a complete accident. I dont know if this was anything similar...but a very sad situation for everyone involved.
The family can file a civil suit even if no charges are pressed aganist her, and they more than likely will just because it is very rare that people dont go for pain and suffering.
Goodness, I feel so bad for BOTH sides. If your SIL wasn't doing anything illegal but just didn't see the biker than she shouldn't be held responsible for the bikers death...it was an accident. Unfortunately it happens, I don't think automobiles and bikes belong on the same roads even with the best protection with reflectors and such, even if people follow speed limits. When I was 17 I was driving down a highway doing the speed limit and when I went over a hill there was a biker and I came within inches of hitting him....neither of us where doing anything "wrong", but it almost happened anyway. This could of easily been my situation accidently killing someone. Poor families...
