Any attorneys/paralegals/legal secretary's here?

DH is a business teacher and is teaching business law for the first time this semester.  He has a question in a workbook that states that a 16 year old commits a crime at the age of 16 (a minor) but is arrested at the age of 18 (an adult).  WIll this student be tried in a juvenile court?

  • Obviously my bus law class did not sink too far into me.  LOL.  I can't be sure.  I want to say yes but then I second guess myself. 
    Not sure what direction we are headed. Either way, I am up for the ride.

  • I believe it depends on the crime,. and even at 16 for some crimes and in certain situations teenagers can be tried as adults.

  • I know, it's confusing. Because if I stole a car when I was 16 but not get tried for the crime until I was 30 years old I wouldn't go through a juvenile court system--or would I?

  • I believe it would depend on the type of crime, the state/local laws pertaining to that type of crime, and it's also probably up to the discretion of the court. So...maybe?
  • DH, a lawyer, says it depends. If you commit the crime as a juvenile, you are tried in a juvenile court. However, if the punishment is long enough that he would still be serving his sentence at the age of 21, he could be "certified up" In the case mentioned above, the juvenile court would hold a "certification hearing" to determine whether or not to move them to adult court. Also, it of course depends on the state.?
