New York Law for Maternity Leave?

Hi there-- I know the FMLA allows for 3 mo. unpaid leave from your job if it's over 50 employees and you've been there for 12 mo before the baby comes.... but what about any New York laws, are there any that provide any guarantees for leave? Or is it totally up to your employer?  What do you do and how much leave are you getting from your employer?  TIA!

  • It's not my area of expertise, but you might want to check the New York State Bar Association's website (www.nysba.org) to see if they have any resources online or perhaps the number of attorneys you can call to ask this question and get a correct and thorough answer.

NY state does not have any maternity rules or regulations, so all you get is what FMLA etitles you to and depending on your employer you might get something else.

    I hope this helps!

  • I'm only getting 6 weeks.

Also, I thought your job paid you what you make a week.  HA, silly me! I have to go on disability which is roughly 170.00 a week.

  • I get 6 weeks paid and 6 weeks unpaid. We also get 2 weeks paid before the due date and the 6 weeks paid start, on the day of your baby's birth. If you live in Germany and work for my company, you get 6 weeks paid before birth and 8 weeks paid after birth, but they will hold your job for 1 year.  Statistics show that America is thee worst country with maternity leave....how sad is that?
