XP: ? about saying u were going back 2 work, then not

If you did this, was there any penalty/repayment you had to do?

DH just got an offer that may allow me to be a SAHM, so it's not like I planned on not going back.

My maternity leave is 8 wks STD, then 4 wks FMLA, using accrued vacation & unpaid time.

TIA

  • I did not do that but - -

I just saw a piece on the Today Show which said to go back for 30 days.

Yes, they can make you legally repay them, especially if you are on FMLA and they are still paying your benefits.

  • Just tell them now.  If part of your maternity leave that is left is unpaid anyway, then just do the right thing and tell them now.

Seriously, it sucks for other women when you pull the not-coming-back thing.  Since you didn't plan for it to work out this way, just do the right thing now.

  • If you plan to do this, tell them as soon as you know.  It's a pretty Shity thing to do if you know you won't be going back, but hold out on telling them to get the time off.  I know you said accrued vacation, but this early in the year, depending on your co's vacation policy you have not earned all of your vacation days for the year so yes, you may have to pay them for your vacation days.  Not including the bridges you may burn by holding out on telling them.

  • Do you have a handbook?

At my old firm, if we didn't come back, we had to repay the benefits - health, dental, STD, LTD, retirement contributions, etc.  All of it.  It was all laid out in the handbook, so there was no mistaking it!

  • I did not have to pay anything back. But after my maternity leave ran out I did use up the last of my vacation time, then gave my notice.
