living will? living trust? regular will??

I've googled and googled and feel more confused now than I did when I started. Does anyone have a suggestion of what to do and how to do it? State registry? Lawyer written? Personally written and then notary stamped?? ahhhhh!!

  • My dad does living trusts and works with a lawyer. I'd recommend going that route.  A trust is much more secure than a will.

  • A trust is the best way to go. ?If you have a will, it can still be challenged in court. ?A trust cannot. ?If you're doing a basic trust you can contact a lawyer to do it for about $2000. ?It may sound like a lot, but it's worth it to have it done right.

  • For your baby? A living will is a medical directive for how to handle your care if you can't make decisions, so shouldn't be relevant here.

    I plan on doing a simple will.

  • well for me and dh obviously. making sure my medical wishes are followed is totally relevant when you don't know if a c-sec will occur or not. But I just want to have everything in line in the case that something were to happen to dh and I. It sounds like a living will and a living trust are both needed.

    Ah, I see. Usually on baby boards when people discuss trust/will decisions the main concern seems to be who will care for their baby, etc. and how the baby's needs will be met financially if something happened to the parents - but sounds like you're thinking more broadly.

  • I have a living will, and a regular will.  I went to a lawyer to get my regular will done, the living will I did on my own and had it notarized.  I'll obviously have our wills redone once this baby is born but I think getting a lawyer to handle things like that is the best option.
