big question

my now ex-fiancee and i just broke up, and since my job doesnt pay enough for me to cover my bills and all the baby things that are left to buy and things for after my baby is born i need him to pay child support.  however i have people telling me that in the state of SC you have to let the child have its father's last name to get child support, does anyone know if this is true or not?

  • I believe it varies state to state, but you for sure will have to list him as the father on the birth certificate.

  • I am a family law attorney in Georgia. I am not familiar with South Carolina law specifically. ? However, I feel fairly comfortable saying that no state requires a child to have his/her father's last name in order to collect support. Child Support is a right that belongs to your child and there is nothing you can do to waive/forfeit that right. ?so don't worry!

    Since you were not married you will need to file a petition for child support, or your ex-fiance can file a petition to legitimize. In Georgia you would have to wait until the child is born to do that, however you would be able to collect a portion of your medical bills as well.?
