Child support - does it matter where I live?

Dumb question, but I'm getting overwhelmed and confused. :)

My girls and I moved in with my mom. So obviously my expenses are less than they were when we lived with my STBXH and I paid half the mortgage. Does my current living situation affect how much he owes in child support?

At this point, I have them roughly 60 percent of the time.

Thanks!

  • No. If you changed states it could. But, that's it
  • No, child support is determined by his income not by your bills.

My child support was determined by his/my income and the percentage of time LO was with each parent (me 100%)

Thank you, everyone. That's what I thought. I have a feeling, though, that he's paying more than he actually should. He pays me about $700 a month, but he has them about 40 percent of the time. That seems too much (I do pay for their insurance, but it's nowhere near $700).

The worksheet we filled out to calculate child support didn't ask the percentage of time he has them. It just based it on custodial vs. non-custodial.

CS for my son was based off of both of our incomes, childcare expenses, medical insurance and they asked if he had him more than so many nights a year, which he didn't. They didn't ask about where either of us lived or any living expenses.

If you can find your state's online CS calculator you should try that. I don't ever mention how much I actually get in CS but for my one son is more than you are getting now from your ex and we are both teachers. So you never know how it will come out.

OK. Thanks! Then I'm guessing the final amount may be altered soon to accommodate more for him having them three nights a week (when he finally does, which unfortunately will be soon).

  • Ultimately, it depends on the state. In Texas, it's a flat 20% of the father's income plu medical insurance plus back child support for one child. How much the mother makes, where she lives, what her expenses are, and how she spends it are irrelevant.

    OK. Thanks for the info.
