I am thinking ahead

I have been talking to my DH and have decided that after the baby is born I need to ask to go back to work part time. DH will work 4 days a week and I will work 2 so that we only need daycare 1 day. Does anyone know if there are any laws that will protect or help me when I ask my boss to go part time? He is going to be very upset about it and I am thinking of looking for another job while on maternity leave.

  • There are no laws saying that your employer has to make such an accomodation, sorry.  Basically, if you cannot return in the same capacity, they no longer have to hold your job. Check the rules on any paid maternity time you may get, because if you end up not going back, you could owe them money.

  • With FMLA. They are required to give you your previous position or an equivalent one back.  They are not required to adjust your hours and are well within their rights to part ways with you if you decide to go part time.  Good luck!
