CS hearing question

DS's bio dad is 18000 behind in CS and has not paid anything in 8 months.  I contacted CS a few months ago and finally got notice that they scheduled a hearing to find if he is in contempt.

The CS order is in Ohio.  I now live in Texas.  The notice they sent me also stated that I am ordered to appear at the hearing.

Can I call and get the okay not to come.  I do not want to spend $300 to fly to Ohio for a 1 hour hearing that he may or may not show up at.

  • I would go. I would also request to be reimbursed for flight since he's the reason you had to fly up. I cannot believe he is that far behind and they are just now doing a contempt motion.

  • I would fly up if it didnt impact so much.  I am a SAHM, my DH travels for work and I have a DS in 4th grade and a 16 month old.  Also, who knows if he shows for the hearing.  I sent him letters and emails offering to terminteate his rights and get out of paying CS but he has yet to ever respond.

    They just filed because I called every few weeks until they did.  He paid $36 in May so they said that reset the clock and they give the obligor 6 months of nonpayment before the county will file contempt charges.

    I hope that in the age of technology I can skype in or phone in. I am not sure why they need me there...I am not the one 18000 behind in CS.

     

  • I called the court and they said I am allowed to attend but am not required.

    The only matter for the hearing is to determine if he is in contempt for non payment of CS and I would not even be asked to testify.

    They said if he no shows they will issue a bench warrant

    I think the magistrate will be hard on him...he owes $18000 in arrears now and is not working and I am pretty sure there are McDonalds and Wal-marts near his house.  She let him have it in 2005 when we 1st had a CS hearing bc he had no job and claimed he couldnt find work...she told him not finding a job he will like is not an excuse to not pay CS.
