Update on BF

He was in reconstructive surgery for nearly three hours yesterday as they repaired his left hand, which was broken in four places. Lots of pins and wires, and he'll need another surgery to repair his carpal tunnel, which they had to sever to relieve pressure and swelling.

He's out of commission for two to three months, which is going to drive him (and me) nuts, but at least he's OK.

Apparently, a crew decided to do demo work on a brick wall right next to him as he was working on another project and it came down on him. He leaped out of the way, so it didn't fall on more of his body, but it still got his left arm and hand.

He should be able to get some kind of short-term disability from his employer correct? I'm not familiar with this kind of stuff.

  • Ouch, that sounds awful.  I believe their workers comp policy should cover him.  If he has STD through them, that might be able to cover anything that's not covered by workers comp.

  • It really depends on his company, his state and what benefits he's enrolled in.

    STD (with compensation) is not always just a given.  Some employers require you to enroll it, there are usually time limitations (ie. have to had worked there for XX amount of days/years, etc). 

    I'm glad to hear that (all in all) he is ok.  That is so scary and I hope his recovery and speedy and painless (for both of you! LOL)!!  Thanks for updating -- I was wondering how he was doing!

  • it would be workers comp, but I'm not clear on what that provides.  I would assume it would provide some income.

  • Since this was on the job, there should be a claim filed and there will be an adjuster assigned to that claim.  STD is a totally separate thing, so if he has a separate policy he should check into that.  However, a worker out due to their injuries will generally get partial compensation while they are out.  In the state I'm in it is 2/3 of regular pay.  In any event, all of those questions can be answered by the adjuster assigned by the insurer.  Good luck to him- that sucks!!
  • Thank goodness he is okay.  That could have been MUCH worse.  Yes, if he is not self employed, his company's worker's comp should come in here.
  • I'm not familiar with workers comp/disability and all that, so I can't help. But, I'm glad he's hanging in there and OK. I hope his recovery goes well!

    ETA: WC benefits would most likely cover medical expenses as well as salary as opposed to STD which would just be lost wages.

    I don't know the regulations where you live, but here there would a Worker's Compensation Claim filed and he would be compensated for his time off work, etc. due to an injury sustained on the job.  Any lingering issues he has for the rest of his career would also be dealt with through Workers Comp.

    Any discussion about a settlement is waaaay premature.  He needs to get through the acute phase of his injury, rehabilitation and then if there are any long term impairments, those will be calculated at the time of his claim closure. As long as his medical is being paid, his lost time from work, etc. there is no need to get litigious at this point.

    Not necessarily. A lot of companies will offer up an early settlement to avoid going through their insurance and risking a premium increase or even to reduce the amount the insurance has to pay out.

    Again, probably doesn't translate from Canada but I can tell you that if a company tried to do this here, there would be big, big problems.  Every claim must be filed promptly and reported honestly or the company faces fines and sanctions that would make your hair fall out.

    Here in California also you cannot pay for your employees injuries as Rides says there would be BIG PROBLEMS you must file a claim ASAP & workman's comp will have an adjuster talk with you BF & work with him on it.
