Maternity Leave & Holiday Pay

Just curious....

Is anyone getting paid for the holidays while they're on maternity leave?  Between Christmas and New years, I would be missing out on about 30 hours of holiday pay, which for me is a whole week.  I asked HR and they said no, but they are researching it. (Small company)  I plan to be out for 6 weeks and will be using PTO that will only last me about 2.5 weeks. 

Does anyone know what the law is on this?  I assume it varies state to state.

  • my first 6 weeks are on short term disability so I get 60% of my normal pay  and my last 6 are just time off I arranged at no pay.

  • I'm in HR and in the state of TX.  We don't get paid for holidays if we're out on disability leave.  For you, it will depend on a number of factors (company size, whether you have short term disability/medical leave, etc).  I'm not sure where you are, but you can google your state and your medical leave laws, etc- however, I'm guessing that holiday pay is not mandated by those and will be based on company policy.

  • I'm kind of getting paid I guess you could say.  I'm a teacher and won't have to use any sick days over the two week break in order to get a paycheck.  Those vacation days are included as non-duty days in our contracts and our salary is spread out over a 12 month period.

    I am in Utah and will try and find information.  I do not have short term disability so I will just be using my PTO time I have accrued.  I work for a small company - less than 100 employees. I haven't officially applied for FMLA but have just worked out the plan with my manager.

  • I am only getting Holiday pay because I arranged to have PTO time off the day before and after the Christmas as well as New Years.  I had to have it approved by my manager in order to be paid for the time we get off.  My company doesn't pay your for any holiday if you don't work the day before and after unless it is approved 2 months in advance.
  • I work at a school so my 2 weeks off for school will be paid at 100% because those are days that I would normally not have to be at school. I am not sure how it works in most places.

  • Unfortunately we don't get our paid holidays while on maternity leave either... Being I'll be on FMLA, I forfeit Xmas & New Year's holiday pay. So I'm really hoping baby doesn't come early because I don't want to miss out on Thanksgiving holiday pay either :)

    I'm 90% sure that I don't get 100% for those days. I think since that falls within that 6 week period then I only get the 60%.

  • My company (a worldwide company headquartered in MA) closes down during the week between Christmas and New Years and I will get holiday pay during that week.  It will put my paid short term on hold since I cannot receive both holiday pay and STD pay at the same time.  So basically it actually buys me an additional paid week of leave.

    ETA:  I get paid 100% either way since I opt into and contribute to an extended STD plan that pays me 100% of my salary while I'm out

  • I go on STD for the first 8 weeks which covers the holidays. My company is closed 3 days during that time. I usually just take it off when I'm supposed to return, extending my leave by 3 days. This is what I did last time (with my manager's approval) as I was out for Good Friday/Spring Day, Memorial Day and July 4th.

  • I'm in CA and I will miss all the holiday pay. Works out o be nearly a week. I work for a large state University.

  • I was told while out on STD, paid holidays are forfeited.... in addition, I won't be accuring and PTO while out on leave.

    Bummer!!!!

  • I do not have STD and will not officially go on FMLA. Rather than "maternity leave", my work thinks of it as just a really long vacation. I will use all of my saved vacation, sick and comp time, which should last me about 6 weeks. Then I'll go unpaid or even work part time from home for a few weeks. I will provide a Dr. note since I'm using so much sick leave but otherwise it's a pretty informal process. It's my understanding that I will be paid for the holidays.

  • i'm 99% sure i get it; i am using PTO while i'm out on FMLA and trying to avoid using accrued time. i emailed our HR person this week but she's out, i'll know more on monday.

  • I am supposed to get holiday pay that week as well. what i was told was that i had to be in PAID status the week before and the week after in order for it to be paid. So, since I have almost 4 weeks vacation/sick/personal time, I will get paid up to the holiday and then for 2 weeks after it so I will get paid. 

     I am not sure if this is the law or just the way my school does it.
