fmla question

I love my job and I love the company I work in...however they have stupid policy where you can only go Maternity leave 2 weeks prior to your due date...which is dumb considering the fact that after 37 weeks, it could happen at anytime.

Anyways I was planning on leaving June 1st but I can't because my doctor has my due date at June 17th rather than the 15th (I have a 26day cycle rather than a 28)

My question is..when could I start my leave if my due date is June 17th? Do I start leave on 6/3 or is 6/3 my last day of work, help!

  • My due date is June 17th and I plan to work until June 16th. Recently I considered changing this but I'm currently working from home daily so I don't see the need to.

    I would think you would want those few weeks on the back end rather than the front. Although I do agree that babies are pretty unpredictable but if I were you I'd try to stick it out as long as I could. Maybe take the week of your due date off?

  • i personally would do 6/3 as my last day of work. its a friday so it will be nice to leave and be done.. also depending on your office they might want to have like a cake or something and probably let you leave earlier

    My due date is June 27th (a Monday).  I plan on working until the previous Friday, unless LO decides to come early.

  • If it makes you feel any better my company does not let you start maternity leave UNTIL THE DAY YOU GIVE BIRTH!  I am a teacher and cannot fathom being in front of 110 8th graders in June sweating my butt off, miserable teaching but I HAVE TO!  Unless I have a medical reason I cannot work.

    Last pregnancy I worked until 2 days before I gave birth as I ended up having my daughter 38.5 wks.  Depends on how you feel and what you do all day at work.

  • Mine starts 1 week AFTER the birth.  So not only do I have to work up until I am in labor practically, but I then have to take one week of PTO first, THEN I can start my leave.  So silly.  I wish the rules were the same across the board.  (And across the world!)

    I would also try to work as long as possible, unless you aren't going back to work (but I am guessing you are, since all FMLA does is guarantee you your job back....).

  • I know FMLA covers your absence for maternity leave and any complications you might have in the pregnancy. I am a teacher too and my school also has the work until you give birth policy. I think that if you want to cut out earlier than your company's policy allows, talk to your doctor. Before I had to stop work for complications, my doctor had mentioned that when I got closer to the end and felt like I couldn't work anymore that she would give me a doctor's note. 
  • I would think work 6/3 and then be off from then on. I have to work up until the day I deliever unless I have complications and the Dr. takes me off early. I just hope that I am not in a patients room and my water breaks all over the floor!
