This insurance issue?

Is making me second guess having DD's party here again with a bounce house and the pool. My brother suggested having people sign a waiver. I doubt anyone would be willing to sign something for a birthday party.

I never realized there really are people out there that jump straight to law suit. I found out today that someone could sue if they fell off their bike on the sidewalk in front of my house. Crazy.

    I deleted the OP since she now has a lawyer. I didn't want it sitting out there. Basically my niece broke her ankle while here with my brother (her ex H). She wants money. The end.

  • My advice is be careful with your guest list.  If you know people who have sued, they are more likely to sue again.  I had a former neighbor who had had several lawsuits she filed against people for rather trivial matters, like a twisted ankle.  I seriously never let her on my property.  I also worked with a couple of people like this and when I rented apartments when I was younger found a few people whose sole source of income was lawsuits, $5 or $10K at a time.  My cousin is an "ambulance chaser", she won't take cases of people who have sued others before, since most people don't have bad luck all that often, unless they create it themselves.  You can't prevent all accidents and that is why you have insurance.  You can get a specific rider for the day of the party if you are concerned.  You should also have an umbrella policy that has at least a $1M limit (we have a higher one because we have rental property) to defend you in case of a lawsuit and pay if there is an award.

    Anyone can sue anyone for anything.  It is the way in this country.

    I won't stop living b/c of it.

  • We cut down our cherrie tree because kids fromaround here would climb our fence. We did not want to be sued by their parents because they fell. It sucks that people want to sue for everything. If I remember right you were willing to put it on your insurance I must have missed another post.
  • I felt the same way after someone threatened to sue us too.  It just really shakes your sense of security and your belief in decent people.  If you rent a bounce house, make sure they're insured.  We also had this issue with family member and a friend, so it is going to be awkward to see them this summer.  I'm going to look like a ***, but I'm not going to let their kids play with mine w/o their parents present.  I used to not care, but now that I know what they're capable of ... I won't take the chance.
