The last sentence confused me. How can it not be cheating if they are still married?

I saw bits and pieces of that show and it made sense.  They were separated and had an agreement.  He slept with another woman.  They made it public that they were separated and he told the media before she* could make a profit out of it.  

In the beginning I thought David was a prick but now I kind of think that this was all planned and agreed about btw him and Courtney.

Well, I guess if they had an open marriage that is not technically cheating. I still think the public announcement of the crying is a bit over the top.

He is upset over the loss of intimacy? What the hell did he think would happen when he had sex with another woman?
