need attorney/lawyer advice asap

I'm about to call a lawyer about a work issue....been forced to go on sick leave even though I can do my job.

Anyway, what questions should I ask about fees and payment?  I plan to tell them the situation and have them guide the conversation but I've never done this before.

  • Can you provide more information? Why would you be forced to go on sick leave? Do you work in a job where there are risks for pregnant women?

  • I really don't see why more info is needed, but I'm a teacher of kids with emotional and behavioral disorders and they often need to be restrained.  I can do all other teaching duties besides restrain.  The district refuses to move me to a regular teaching position.  I'm actually not even certified for the position I'm currently in.
  • Contact the EEOC they may be able to answer any questions you may have. 
  • Just be up front - ask them what their retainer fee is what their legal fees are as the case goes on.

    Are you part of any type of union?  I know that my teacher's union will provide teachers with representation for these type of issues.

    yeah....my union right now appears to be a joke.  it took 2 days for them to call me back and then they haven't heard of a case like mine before.  I asked her at what point a lawyer comes in and she says she doesn't know.

    OMG that is ridiculous. I'm sorry I have no legal tips for you, but I can't imagine that you wouldn't win this case. Good luck.

  • for employment issues you should be able to find good employment attorneys that will talk with you and give you a free consultation over the phone or in person.  I am an employment law atty and listen to callers and their problems.  If I think there is something I can do to help I have them come in.  As for fees, it can be either a contingent based fee or hourly/retainer based fee.  Contingent based fees work if a lawyer will be filing a case for you and their fee is a percentage of what they collect for you.  in this case to deal with your employer it might be more of an hourly based fee or retainer the atty works off of.  The atty should be able to explain all this to you in your initial call.  Good luck!

  • This is a good question to ask on the P&CE board - there are quite a few attorneys over there specializing in just about anything you can think of - they always have very sound input re legal issues.
     
  • Your union should have its own attorney who will handle your case.  You shouldn't have to pay for one out of pocket.  Push the issue with your union rep, or go higher up the chain until you find someone who will deal with the issue.  Most union attorneys are helpful because they know the contracts inside and out, and they know which cases win and which don't.  I'm a lawyer, but not in MD, and not for a union.  However, I have friends who did work for unions in the past and I really think you should take that route first.
