nbr- confused about ticket

In order to get a lower fine for a speeding ticket do I have to plead not guilty and go to court?

The ticket court is at 1:00 on a Tuesday.  I'll pay a fine but I don't want any points or anything.  The officer said he would recommend a lesser charge because I was polite but he didn't note it anywhere on my ticket- it's for 80 in a 65mph.

  • you should definitely plead not guilty and go to court. In order for the charge to be lessened at all that is what you need to do.

When you send in the ticket,(with a not guilty plea) they will most likely send you a different court date. You would definitely get points on your license if you pled guilty and paid the fine.. And it would likely be a BIG fine..

Thanks!  I kind of thought you always are supposed to plead not guilty.

  • Yes, plead not guilty and go to court.  You will most likely plead guilty to failure to obey a traffic device, which is a lot less of a fine than speeding.  But even if you plead not guilty and go to court, you'll still get points on your license, but not as much as if you pled guilty to speeding.

Not necessarily.. I have gotten a few speeding tickets and they've always been reduced to a parking ticket (or two parking tickets),  which avoids the state surcharges and any points on your license.. One time I did have to go to traffic school though..

ugh.  I forgot about traffic school.  I think I've been twice but the last time was probably just over 5 years ago.  I wonder if they'll make me do the school in the Monroe county where I got the ticket too.  It will be worth it to avoid points though

  • It also depends on where you get the ticket - the city of buffalo does not plea, even if you bring a lawyer.

Your insurance won't go up with a few points on your license...most of the time they never even find out unless you have to change something or go to a different company and they run your license through the system. It's when you do something severe and get so many points that your license gets taken away or a DUI or something - then they are notified.

Really? That's great!  I'm sure it depends on where you go.  When I had my ticket, almost everyone pled guilty to failure to obey a traffic device.  That state surcharge is crazy, I think it was almost as much as the fine itself.  And I think I got 2 points on my license.  I should speed where you speed!  Stick out tongue
  • In the past, I called the town office, and they instructed me to send it in not guilty and write a letter to the DA.  This has gotten me a reduced ticket charge (no points) and I did not have to appear in court.
