SO, as some of you may or may not remember, due to some drama involving police and my neighbors' door getting broken in, my DH and I decided we wanted to try and get out of our lease early and move. Well, we called the landlord to talk to him about it, and he was gracious and understanding... and very disappointed. We said we couldn't find our copy of the lease so we're not entirely sure when it's up but it's either June or July. Well guess what? HE can't find HIS copy of the lease EITHER!!!!!!! Which means... he can't stop us even if he wants to cause he doesn't have any proof that we're even breaking the lease. Thank you JESUS!

Wish that would have happened to DH and I when we were living downtown for 3 years. Ugh, hated that apartment! Our upstairs neighbors dumped beer all over my motorcycle! Then the @ssbag proceeded to drop his cigarette on it. I was not a happy lady.
Just be careful. If he finds the lease, he can still prove that you broke lease and can legally collect on rent that you did not pay.
Not having it in his hands does not void the legality of signing a lease.
Ugh I had this problem when I lived in my old apartment. I have a 02' Honda CBR 600RR, it's my other baby
. And I swear someone living there had it in for my bike, we had no garage parking so in the Summer I would park it next to my car and EVERY single week I had a mirror ripped off, or a new scratch, once I even came out to see it tipped over! That was reason enough for me to get out of there and buy a house with a big garage haha.
I'd definatly try to get something in writing about your lease being up. We all know landlords aren't the most honest people and if he's hard up for $$ then finds your contract he might try to come back and sue you for rent not paid. Awesome that it worked out though!

Totally, I know. And we are planning on getting something in writing from him saying he is releasing us from our obligation. He isn't trying to strongarm us, so I think it will be ok, but the fact that he can't even say for sure when our lease ends makes me feel alot more confident that we won't have to beg.
