Quick and dirty on CA adoption law?

we have a potential situation we're looking into, and I need a quick and dirty on CA adoption law for those in the know. Correct me if I'm wrong and fill in the blanks:

BM has until hospital discharge to change her mind/sign paperwork

No advertising by PAPs

BF doesn't need to sign off on adoption plan

What is the law on contributing to living//medical expenses?

    BM has until hospital discharge to change her mind/sign paperwork - BM has up to 30-days after tpr is signed to change her mind.  TPR cannot be signed until she is "Discharged".

    No advertising by PAPs - Correct, no advertising.

    BF doesn't need to sign off on adoption plan - He doesn't have to sign off, but your attorney needs to make an attempt to contact him and get him to sign, if he doesn't respond or refuses to sign, as long as attorney can show attempt, his rights are terminated.  If the BM doesn't know who the father is, there was a LONG time period he has to come back into the picture.  I remember thinking, why to BF's have a longer time to come back the BM's when they explained it.  Sorry I can't be more detailed.  The agency told us that in those cases, the courts "generally" side with the AP's because they are all the baby has ever known, and the BF was never around, didn't live with BM, didn't provide support, etc.

    What is the law on contributing to living//medical expenses? - You can pay reasonable living expenses, and BM will probably qualify for medi-cal.  You can pay living expenses up to 4-weeks (maybe it's 4-months, don't remember exactly) after birth.  I know there are dollar limits though on expenses, for instance, I could only spend $500 on maternity clothes for our BM.

    I just heard about this situation and won't have more details until next week, but wanted to start getting our ducks in a row in case this works out.

  • TPR can be at the time of signing if she signs a waiver up front stating that her signing indicate she doesn't want to use the 30 day revokation period.  I am fairly certain about this.  That is what my attorney stated.

    TTC since May 2006. After 3 failed Clomid cycles, 2 failed Injectibles/IUIs, 2 failed IVFs and 1 failed FET, we moved on to adoption!

    Last ditch FET resulted in BFP, and identical twin girls!

    We will get more information on the situation sometime next week, and we'll be talking to someone at our agency by then as well. I know next to nothing at this point, but wanted to know what the laws were so we can be prepared.
