Thanks for the HR advice refering to FMLA, Does the federal act require that the 50 employee's be full-time? Also, We do not have anytype of HR dept., I am thinking that putting my request in writing would be the best way to let my boss know that this is the direction I am thinking of going. Maybe a sitdown meeting along with it in writing?? Thanks

I don't believe that it needs to be 50 full-time employees (I have always worked for very large companies so this has never been an issue for me).
I see you are in Michigan. From a quick Internet search, it doesn't appear that Michigan has a leave policy that is different than the Federal FMLA.
In writing is always best, with a follow-up meeting in person. You cannot be retaliated against for using FMLA (denied the leave if you qualify, passed for promotion, denied raises you are entitled to, etc). If you don't have an HR department, it is possible that your supervisor just isn't as familiar with the law.
