If I have off from work for a holiday and don't need her, we still pay her. I get holiday pay, therefore she gets it too.
If I take a day off and dont' need her, I still pay her. It's not her fault I don't need her.
However, if she takes a day off or is sick, she doesn't get paid. This actually has not happened yet, but she knows she won't get paid if she calls in.

11 standard holidays, 2 weeks of vacation chosen by her and 2 weeks of vacation chosen by us (at minimum -- she gets her weekly salary whether we use her or not). I didn't limit her sick days because I knew she wouldn't overuse them and, really, if she is sick I'd rather she not be near my kid.
We are on the high side with vacation time, but we have family in the area and can work from home if necessary, so backup care is not a huge hassle for us and I would rather offer more vacation than higher pay.

She gets two weeks - we pick one and she picks one - since we share her with our neighbors we will need to coordinate that. ON TOP OF THAT, she gets the week between Christmas and New Years off. This year she actually got a week and a-half off because we were gone before Christmas. She gets three paid sick days but frankly I would work something out with her if she were really sick - I guess we could require her to take vacation time. She had to take time for a dr's appointment a few weeks ago and we didn't require her to take any of her time. And 11 paid holidays. She gets more time off than I do execept that I accrue sick days over time. We were pretty much stuck with what she had from her previous employer. If you can believe it she actually wanted two additional (state) holidays and we said no to that since none of us had those off.
Since there are four of us adults involved it's a little easier to juggle her time off.

10 days PTO; 5 of her choosing, 5 of our choosing. PTO is any type of paid time off - so vacation, skill, whatever.
The reality is that we actually pay her more than that since DH and I have very generous vacation banks.
*Edit* She also gets 8 paid holidays (the standards: Thanksgiving, Memorial Day, etc)
