Maternity vs. Disability question...HR people.

I am not ?getting a maternity leave due to the fact that I have only worked for my company since June of this year. ?I do however get a 30 personal leave-unpaid and no guarentees on a position if you need to be off past that point. ? My doctor has taken me out of work as of today due to preterm labor signs. ?So, would I qualify for disability until the baby is born or is my 30 days starting as of today and I am completely out of luck or what??

I know this is obviously a question for HR or the director, both of whom I am waiting to hear back from.?

  • You would qualify for disability pay through the state. I went through the same thing with PTL with DD. Your dr should have the forms you need. Call their office.

  • Until the baby is born is disability, then the recovery from the birth is disability (more for c-sections). Any time after that would be family leave.
  • It also depends if you pay into STD or not.  I work for a City and we have private disability insurance so for me it doesn't kick in until being out of work for 41 consecutive calendar days.  If you pay into government funded disability you should be fine.
  • I am in NY. ?They aren't offering FMLA because I haven't been there 12 months. ?Also, I am only employed part-time.?
  • It depends on your benefits plan.  Usually STD (short term disablity) is only offered to FT employees however check with your HR person.  If you are infact eligible for STD then there is usually a waiting period (as little as 7 days some places and as long as a month at others) before it actually kicks in.  During that time you are expected to use any accrued vacation, sick or personal time you have to get paid.  After that you then have to file a claim with the STD carrier who will review the claim and then pay you out a check (usually anywhere from 60-75% of your normal pay, again depending on your company's plan).  The sooner you get your paperwork filled out by your doctor and turned into your provider the quicker you will actually get some money coming in.

     As for the 30 days after birth that would not be affected by your time off and should still be paid under diablity.  However you do need to talk to your HR person asap about the fact that you will need significantly more time off.  Also realize that most companies have a clause in their STD coverage stating you have to return to work for a certain period of time after the birth (usually at least 90 days of work) or they can ask for the money back.

  • For us (and I don't know if yours is the same) any time taken off pre-birth is covered under STD once we hit the elimination period. Before that we use any accrued PTO time. It does not impact how long we can take post-birth but legally they do not have to hold your job if you are out more than 12 weeks under FMLA. Since you don't qualify for FMLA I would think you will probably get paid but may not have a job to come back to (assuming you have STD coverage).
