So custody agreement says that kids are due home today (July 31st) at 6:00 pm.

They are still in TN ( we are in TX) BM has not sent us any flight confirmation information. (required in our custody agreement) She is saying that she is flying them back home on Sunday. But we aren't sure if tickets have even been purchased yet. On Wed. she said she was buying them- and prices were close to $480 each.

She is also saying that since today is the 5th Friday of the month- that she doesn't have to return them until Monday. But the custody papers clearly state that the kids are to be returned home July 31st at 6:00.

What do you think? If we need to report this- who do we report to? I looked through the custody agreement today and there is no phone # of who to contact if kids aren't returned on time. TIA!

  • Do you have a lawyer? If not, you can call the police and let them know that the children were supposed to be returned at such and such date and time and they are not with you and they are somewhere out of state. They'll handle it, plus it'll be documented in the system and you'll have solid proof of BM's contempt.
  • We do have a lawyer- but were trying to avoid lawyer fees if there was some other way to report it.

  • If you want to report it call the police. That way there is a report of whats happening. Remember too though that since they are out of state and not returned it could be consitered a SIGNIFICANT crime (kidnapping over state lines kinda thing) so things may become more involved than you are looking for them to be. Police often have to enforce the law even if the person reporting does not want to press charges.
  • Can you get a hold of whoever they are with in TN to see what is going on?  Then you would know if they actually have a ticket or if you need to report this.

    Maybe you can call her and tell her the agreement states that they are to be returned today.  That you want to see a copy of the travel confirmation by the end of day today showing they will be returned on Sunday (against the CO) or you will be reporting it to the police that she has the children against a court order.
