my job's FMLA paperwork is all fvcked up.

this is one of the conditions for fmla at my job...

If the duration of my family/ medical leave (total of paid and unpaid time) does not exceed 12 weeks, I will be returned to my same or an equivalent position, only if available, in accordance with applicable laws. If my same or similar position is not available I understand that I may be terminated.

uh, yep, not signing that. i will be talking to the payroll lady on monday... they HAVE to protect my job for 12 weeks (or at least A job for me)... dumbasses.

  • Yes, they DO have to let you come back to at least an EQUAL paying job after 12 weeks FMLA.  However, when you return it is MY understanding that they can choose to let you go after you return.  Good Luck!
  • It's my understanding that if your position was going to be eliminated ( due to downsizing, restructuring or whatever) than FLMA doesn't protect your position.  They just can't fire you b/c you are one FLMA. I learned that little bit of info after my company was bought out and potential changes were going to happen while I was on leave.
